Always file an "Appeal" if your Denial allows for it!

Recently heard about a claim a State resident made to the Attorney Generals office for Discrimination!  After a year the Attorney Generals office wrote back saying that they (on the surface) did not find any discrimination, however they went on to say that does not mean that they actually completed their investigation.  In essence they were just giving it a quick "once over" review.  The letter outlined steps to take if you did not agree with their decision.
Since their decision was not based on a real and in-depth investigation an Appeal letter was sent.

Too Report or not too Report a Claim!

Have you ever "not" reported a claim to your Insurance Company because you did not want have your policy cancelled?  Maybe you tried to read your policy and felt there was no coverage!  In my opinion you should report the claim and let the insurance company make their decision.  Most likely if you have to report your claim to an Insurance Agent they might deny it before it is presented to the carrier.  In that case again my opinion would be to make sure the agent reports it to the actual insurance company.

Then if your claim is denied, have the carrier put it in writing, and post your story here on "Case Denied!"

New World Order!

Do you accept a rejection or denial from the start or do you stop and think about it.  Have you filed a claim, requested something and been denied.  What was your first thought after receiving the denial?  Let it go, don't rock the boat, those people know more than I do?

The World is changing ever second of every day and you need to not only "survive" but ask questions and do not accept everything as "fact".  Check it out for yourself, follow up, do research and let others know of your situation and story!

We all have stories to report, and others are not reading your story to judge you, they are reading your stories to either assist you or learn from you.

Very tragic accident to a very young man doing his job and trying to protect and save others!

Will this claim be considered a Workers Compensation claim as the Lifeguard was working for the Water Park, or will there be a Law Suit based on some sort of Employer Negligence?

Labor Day Weekend 2011

Now with another Holiday behind us, many people and companies will be filing new Insurance Claims.  Medical, Property/Casualty and so on.  Insurance companies are normally inundated with new claims after a Major Holiday!

Need to get the Word Out! Share your Case/Claim Denied Story

I know from just watching the News that hundreds if not thousands of people have had their lives changed when a Case/Claim was denied.  Most are medical claims where a procedure was denied, or a property claims where there an exclusion!

"Irene" Here come the "Adjusters!"

Hundreds if not thousands of Staff, Independent and Cat (Catastrophe) adjusters are either already in or headed to the East Coast.  Before the water dries and the winds calm down adjusters will be hitting whats left of the streets to try and inspect and make their recommendations on coverage and payment for the damages.  Those without insurance or those who have their claim denied will seek FEMA for assistance.

Three things can happen if your claim is investigated at the very beginning.  You will be paid, but most likely not enough and your claim may require a supplement.  You will be told that "coverage" is pending and someone will be in contact with you.  Or third your claim will be denied on the spot (for various reasons).  Also in some States there will be "Public Adjusters" who represent you the Policy Holder.  Again in most States they take 6% of the total amount recovered.  In some cases they can be beneficial, however you must realize the process or procedure they take does take longer.

The best thing any property owner can do is to not sign anything until they have "all" the facts.  Facts concerning what potential assistance they can get from FEMA, what their own policy covers and what is going on in the City and area they are in.

Also, while there are very good and experienced contractors in and around the East Coast, be assured that many from far away are also flocking to the East.  Property owners need to be extreamly cautious in who they talk to, and who they let work on their property.  Also never give any kind of advance money to anyone even if they say they can not start work without it.  Contractors may tell you that if you do not sign up with them now you will not be able to sign up later as there are so many needing their services.  Again, best to wait a bit longer and be sure.

Check with your neighbors, Government authorities and of course the Internet to verify everything.  It is best to spend the time up front making sure all is in line, then trying to clean up not only the storms mess but the mess of paperwork that is left behind.

A Claim Delayed can become a Case Denied

The longer your "claim" is delayed, the better the odds that it will most likely be Denied.  Most, not all Insurance Companies train their adjusters to first look to verify coverage.  Then they are to look for possible "exclusions" or potential reasons to deny the claim.
While there are numorous reasons for the insurance companies to look first to deny the claim, you also have to understand the volume of claims they receive.  As with any business you need to filter out what you can so you can use your limited resources on those things that need your attention.  However, if the insurance companies would hire more adjusters and limit the number of claims each one handles, I'm sure the adjusters would be looking to find or provide coverage versus trying to deny.
My suggestion would be if you are going to file a claim, you need to read your insurance policy first.  This means that you should actually read the policy well before you need to.  You need to remember that the adjusters are trained to read the policies and you are not.  Make sure you know or at least have a good idea of what the insurance company will do when you present your claim.  If you are not surprised by their decision, you have done your homework.  Yes you need to report your claim timely, but you also need to read your policy and understand your coverage and exclusions.

Deductibles / What's in a Name?

The first story since the Name change will be something that has just happened to me!

At the start of this year I had Health Insurance with a company called "Star-Mark" "Trust-Mark" and I had a $2000.00 deductible.  April 1, 2011 the company moved it's group coverage to United Health Care.  As I had met my $2000.00 deductible United Health Care gave me credit for it.  Then at the end of June 2011 the company I had worked for was no longer going to offer me Health Insurance so I contacted United Health Care. They told me about a Portability Policy I could get with one of there other companies Pacific Care.  Then I find out that Pacific Care which is owned by United Health Care would not give me credit for the $2000.00 deductible I had already paid.  Also come January 1, 2012 I would have yet another $2000.00 deductible.  

I did file a complaint with the DOI and I did get a standard response from United Health Care.  In short it was not a policy benefit to waive the deductible.  I will of course follow up with the DOI and continue my quest for "justice."  

Interestingly United Health Care went out of their way to let me know how fortunate I was that Pacific Care would even insure me with preexisting  conditions.

Name Change! Now "Case Denied"

The original Blog was "share your insurance stories", now changed to "Case Denied"  This site is dedicated to those "real people" who's life has been changed, when a claim they filed was "denied."  It can be a Medical, Auto, Property / Casualty claim or any request you made that was denied.  I'm hopeful that this site with all the stories that will be collected in one place, others will not only see how this impacted your life, but may help them to avoid the same pitfalls.
Sharing does several things, one of which is to let others know the pain and suffering you experienced by the denial, and another is to "warn" those that might be in the same situation.
